TERMS AND CONDITIONS
 
APPLICATION
All interested buyers will need to apply for allotment on a prescribed application form (supplied by the company) duly signed by the applicant along with the Earnest Money. Allotment will be made on first come first serve basis. Buyers willing to make onetime payment in full, shall be given a special discount on the price of the apartment. Allotment of apartment will be made and confirmed only upon receipt of the Earnest Money.
 
PAYMENT
The purchaser will make the payment as per payment schedule. All payment should be made by A/C payee cheque or Bank draft or pay order or cash in favor of Samata Properties Ltd. Payment from overseas in US Dollars/ Pound Starling will be calculated at the prevailing official conversion rate of Bangladesh taka on the date of payment
 
SHEDULE OF PAYMENT
The allotee must strictly adhere to the schedule of payments indicated in the allotment agreement. Delay in payments beyond the schedule date will make the allotee liable to pay a delay charge of 3% per month interest on the amount of payment delayed. If the payment is delayed beyond 90 days, the company shall have the right to cancel the allotment. In such an event the amount paid by the allotee will be refunded after deducting 5% of the total sales price only after resale of the apartment.
 
LOAN
Should the allotee desire a housing loan, the company will only do all that is possible to help secure the loan.
 
SIGNING OF DEED OF AGREEMENT
After confirmation of allotment, the buyer has to sign the deed of agreement within 30 (thirty) days from the date of making the payment of Earnest Money.
 
POSSESSION
The confirmation of allotment will be accorded by the company after completion of installments and other charges. Until and unless the dues are fully paid, possession of the apartment will not be handed over to the allotee.
 
SPL’S RIGHT
Samata Properties Ltd reserves the right to accept or reject any application for an allotment. The company may make limited changes in both design and specifications of the projects, should these become necessary due to Govt instructions or unavailability of the materials. All information contain in this brochure and plans are subjected to change as may be required by the management or the Architects of the company (All measurements mentioned in this brochure are approximate).
 
ALLOTMENT TRANSFER
Until making the full payment, installments and other charges, the buyer shall not have the right to transfer the allotment to third party other than the buyer’s wife/ husband or children without written approval of the company.
 
TRANSFER AND REGISTRATION
The company will register a deed of sale in favor of the buyer after receiving the price in full. The buyer shall bear all the cost relating to stamp papers and all taxes (such as Transfer Fee, Stamp Duty, Gain Tax, Registration Fee etc.) registration of deed of sale on valuation of the space with proportionate share of land, Power attorney if any, legal costs, VAT or any other taxes imposed by the government in connection with transference of the apartment will be borne by the alloteee.

Each allottee will become a joint shareholder of the land proportionate to the apartment area.

After taking over of the apartment/ the project the allottee(s) must consult with the company prior to undertaking any structural/ layout changes within the apartment complex. Failure to do so will be at the sole risk of owner.
 
INCIDENTAL COST/ UTILITY CHARGES
Connection charges/expenses relating to gas, water, sewerage and electric connection, sub-station, generator etc, are not included with the price of apartments. The purchaser will also make these payments in favor of the company as cost to cost basis.
 
FORCE DE MAJURE
In the event of natural calamity, civil war, strike, war or any act of God beyond the control of the company, then the company shall not be held liable for any delay or postponing the project.
 
OWNER’S ASSOCIATION/ OWNER’S RESPONSIBILITY
Maintenance of all common services and facilities after completion of the project will be done by respective owner’s co-operative society, which will be formed in due time. Each apartment owner will deposit Tk. 25,000.00 (Twenty Five thousand) only to the company for the reserve fund of the society after taking possession of apartment. Income of reserve fund shall be used for maintenance and repair of common facilities of the project. Monthly establishment expenses including electric charge for lift, lighting the common area, pumps proportionately as fixed by the society will be paid by the apartment owners.
